Staffing:
Hiring freeze still in effect, but exceptions for COVID-related or essential positions with DNR secretary’s approval.
Waste & MM Program did get approval to hire a Hazardous Waste Engineer to work on licensing.
No budget info to share.
All staff still working at home.
Rulemaking:
Coal Combustion Residual rule writing ongoing, working with Environmental Protection Agency to ensure “as
protective as”
Firefighting Foam emergency rule approval request at October 28 NRB meeting (postponed approval in August)
mostly affects how entities that test firefighting foam should store, contain, treat, and dispose of foam
Hazardous waste rule in effect September 1.
Beneficial use rule effective November 1.
Electronics recycling rule writing in progress, will have public input opportunities this fall
General Program:
No update on Legislative Audit Bureau program evaluation of state recycling program
Waste Characterization Study started; thanks to John Welch and Dane County LF for letting DNR staff visit during
the sort this week. Final report expected by March 31, 2021
Natural Resources fall magazine includes articles on recycling and E -cycling

Questions

How can the Study Group play a role in WisPAC’s Recommendation 1.2? Develop recommendations for management of PFAS-containing landfill leachate: https://dnr.wisconsin.gov/sites/default/files/topic/PFAS/wispac/DraftActionPlan20200916.pdf Brainstorming/ideas:

  • Can this be a way to minimize impacts to landfills as well?
  • What options are there – pre-treatment of leachate only? Financial impact on landfills.
  • Lack of regulation on disposal of PFAS material.
  • Concern with report: treats Wastewater Treatment Plants different than landfills. Landfills viewed as a source, which is not accurate.
  • Pretreatment of leachate at landfill is focus in the report, rather than pretreatment at a WWTP
  • Original action 1.2 in report was that DNR would set a PFAS leachate standard, and it now talks about discussions with stakeholders to figure out safety and how PFAS could be minimized. Has been improved.
  • Do we know of technologies to treat leachate? That are most cost effective and effective at removal?
  • Is it possible to treat biosolids instead before landspreading? More cost effective?
  • Review information from Vermont – treat but not eliminate PFAS. Notes that landfills may be final sequestration location. There are costs to managing that waste stream.
  • (from Skype chat: The product stewardship action 6.1 in Action Plan does mention phasing out and potentially banning PFAS-containing products. The plan also incorporates several comments from the public and external advisory groups regarding eliminating PFAS from products)
  • Technology not there to safely dispose of concentrated PFAS after treatment
  • People still being exposed to unhealthy levels of PFAS so do need to take action; also is political resistance DNR will be sending out a link to a survey specifically designed for public comments. There will be an option to submit written documents. (From Jason Lowery of the DNR Office of Emerging Contaminants) ----Could provide general comments from WMM Study Group: want to collaborate and work with DNR on this issue:
  • --- Send from Group, signed by chairs: “We extend appreciation to WisPAC for work done and look forward to participation with and outcomes of Action Item 1.2. Please contact us if you need more information.” ---- Then members can offer technical expertise and the Group overall could provide consensus with recommendations/outcomes or state where members have different opinions within the Group → All members agree on this. Meleesa and Chad will send out a draft to the Group before sending to WisPAC.

What questions are you getting about PFAS disposal options? What is your response? What information do you need from DNR/EPA?

  • Brown County currently does not have specific disposal guidelines. Not asking/testing material coming in. If guidance developed, will refer to those parameters for special waste application.
  • Guidance would be extremely helpful. Future regulations put upon site needs to be known.
  • Even if guidance comes out, it wouldn’t give you any legal protections down the road.
