Questions are drawn roughly equally from the lecture material and the readings (GP chapters 2, 3, 15 & 16, and the Constitution). Pay attention to the following: e All terms and definitions e ° unitary a System in which a central government has complete power over units or states. confederation 1» Loose association of states or territories that have very little power vested in a central government. i.e: United Nations. federation «A system in which governmental powers are divided between a central government and smaller units, such as states. concurrent powers « Powers shared by Fed and State governments horizontal federalism = Constitution regulates relations amongst states. = Full Faith and Credit Clause interstate compacts « Agreements between states to cooperate on solving mutual problems, Congress must approve. preemption s Exclusion of State Action that might interfere with an already existing Government statute or decision. nullification = An attempt by states to declare national laws or actions null and void devolution Delegation of Federal Powers to state or local bodies. Jim Crow strict scrutiny = Assumption that actions by elected bodies or officials violate constitutional rights. intermediate scrutiny . a legal test falling betwen ordinary and strict scrutiny relevant to issues of Gender; Supreme court will allow gender classifications in laws if they are substantially related to an important government objective. suspect classification = Arbitrary designation of a group for special treatment by government. Selective incorporation s Gradual spread of the protections in the Bill of Rights to the States by U.S congress. habeas corpus a person who is arrested must have a timely hearing before a judge. bill of attainder = Person is guilty of crime that carries death penalty w/o a trial. e Lecture material on constitutions and their functions e the English documents that form our constitutional heritage
