  1. It has been said that there is currently a great deal of dissatisfaction with the duty of disclosure in the context of insurance.

To what extent do you agree with that assessment?

  1. Write short notes on BOTH of the following:

(a) effectually executed diligence in receivership

(b) diligence on the dependence

  1. Explain the various ways in which a bill of exchange may be discharged.
  2. Explain the requirements for constituting an effective security over incorporeal moveable property.
  3. Your client is the director of a small family company. The company wishes to expand and is currently negotiating a loan with Friendly Bank plc. Your client has been asked to act as a cautioner for the loan and seeks your advice as to the extent of his liability and his rights if he agrees to so act. Advise him.
  4. Discuss the operation of the rule nemo dat quod non habet and the exceptions to that rule in the context of the sale of goods.
  5. Explain the main types and characteristics of charterparties.
